1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Kling Motion Control at klingmotioncontrol.pro (the "Service"). By accessing the Service, creating an account, uploading materials, or generating a video, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Kling Motion Control is a reference-guided AI video service. You may upload a portrait or character image, a reference performance video, prompts, and related inputs to generate a video in which the selected subject follows motion derived from the reference video.

AI generation is probabilistic. Outputs may vary in quality, fidelity, accuracy, timing, identity consistency, or suitability for a particular purpose. You are responsible for reviewing an output before publishing or using it.

3. Accounts and Security

You must provide accurate account information and keep your login credentials secure. You are responsible for activity conducted through your account unless caused by our failure to use reasonable security measures. Notify us promptly if you believe your account has been accessed without authorization.

4. Your Inputs and Required Rights

"Inputs" include all images, videos, likenesses, characters, prompts, audio, marks, and other materials you submit to the Service.

You retain any rights you already hold in your Inputs. You represent and warrant that:

• You own your Inputs or have all permissions and licenses necessary to upload them and use them for AI video generation.
• You have any required consent to use a person's name, image, likeness, voice, performance, or other identity attribute included in your Inputs.
• A reference performance video may be used only if you own it or have the right to use it for this purpose.
• Your Inputs and intended use of Outputs do not infringe copyright, trademark, publicity, privacy, contractual, or other rights of any person or entity.

You grant us a limited license to host, process, transmit, and display your Inputs and Outputs only as necessary to provide, secure, maintain, and improve the Service, and as otherwise described in our Privacy Policy.

5. Outputs and Usage License

"Outputs" are videos or other results produced by the Service from your Inputs.

Subject to these Terms and any applicable third-party rights:

• Free trial outputs are licensed for your personal evaluation only. They may not be published or used for advertising, promotion, client delivery, monetized content, sale, or any other commercial purpose.
• Paid outputs generated using purchased credits or an active paid subscription include a commercial-use license from us for uses such as personal brand content, social media posts, courses, advertisements, and client projects.

Our commercial-use license applies only to rights that we control in the Service and Output. It does not grant rights in any third-party Input, likeness, performance, trademark, copyrighted work, or other material. You remain responsible for having the rights required for your Inputs and for your final use of each Output.

6. Prohibited Uses

You may not use the Service to:

• Upload or use materials without the necessary rights or consent.
• Impersonate, deceive, defraud, harass, defame, or mislead others, including by presenting synthetic content as an authentic endorsement or recording without permission.
• Create unlawful, abusive, exploitative, sexually explicit, or harmful content involving minors.
• Violate intellectual property, privacy, publicity, consumer protection, or other applicable laws.
• Circumvent security, access controls, credit controls, usage limits, or payment requirements.
• Disrupt the Service, probe for vulnerabilities, distribute malware, or access another user's account or content without authorization.

We may remove content, suspend generation, restrict an account, or terminate access when we reasonably believe these Terms or applicable law have been violated.

7. Credits, Plans, Payments, and Refunds

The Service may offer free trial credits, one-time credit packs, and recurring subscriptions. Current pricing, included credits, renewal terms, and plan features are displayed on the Pricing page at the time of purchase.

• Free trial credits are provided for evaluation and do not include commercial-use rights.
• Paid credit packs and paid subscriptions include commercial-use rights for eligible Outputs under Section 5.
• Subscription credits and renewal terms follow the plan displayed at checkout.
• Unless required by law or expressly stated otherwise, payments are non-refundable after credits have been issued or used. If a billing error occurs, contact us for review.

Prices and plan features may change prospectively. Changes do not alter a completed purchase without notice as required by applicable law.

8. Storage, Privacy, and Analytics

We process account, usage, uploaded asset, generated result, and payment-related information to operate the Service. We also use analytics and session-observation tools to understand product usage and improve the experience. For more information, see our Privacy Policy.

Do not upload sensitive, confidential, or regulated materials unless you are comfortable with their processing as necessary to provide the Service.

9. Intellectual Property in the Service

The Service, including its software, design, branding, and underlying platform features, is owned by or licensed to Kling Motion Control and protected by applicable intellectual property laws. Except for the license expressly granted for eligible Outputs, these Terms do not transfer ownership of the Service or its technology to you.

10. Availability and Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free availability.

We do not guarantee that a generated video will meet your creative, identity, marketing, legal, platform, or commercial requirements. You must review Outputs and confirm that you have appropriate permissions before publication or distribution.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Kling Motion Control and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from your use of the Service.

To the fullest extent permitted by law, our total liability for claims arising out of the Service will not exceed the amount you paid to us for the Service during the twelve months preceding the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Kling Motion Control and its affiliates, officers, employees, and service providers from claims, damages, liabilities, losses, and reasonable expenses arising out of your Inputs, your Outputs, your use or distribution of Outputs, your breach of these Terms, or your violation of another party's rights.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access, remove content, or restrict features if you breach these Terms, create risk or legal exposure, or misuse the Service. Provisions that by their nature should survive termination, including usage restrictions, intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

14. Changes to These Terms

We may update these Terms as the Service changes. Updated Terms take effect when posted, unless a later effective date is stated or applicable law requires additional notice. Continued use of the Service after an update constitutes acceptance of the revised Terms.
